1. Acceptance of Terms

By accessing or using the Service, you confirm that:

• You are at least 13 years old (or the applicable age of digital consent in your jurisdiction)
• You have the legal capacity to enter into a binding agreement
• You will comply with these Terms and all applicable laws and regulations
• You agree to our Privacy Policy, which is incorporated into these Terms by reference

2. Account Registration and Security

2.1 Account Creation

To use certain features of the Service, you must authenticate using your Discord account. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Responsibilities

You agree to:

• Provide accurate and complete information when registering
• Keep your account information up to date
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with third parties

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason we deem appropriate.

3. Use of the Service

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes.

3.2 Acceptable Use

When using the Service, you agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any illegal, harmful, or abusive purposes
• Harass, threaten, or harm other users
• Spam, flood, or send unsolicited messages through the bot
• Attempt to circumvent security measures or access restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scripts) to access the Service without permission
• Distribute malware, viruses, or other malicious code
• Impersonate any person or entity
• Collect or harvest user data without consent
• Interfere with or disrupt the Service or servers
• Use the Service to violate Discord's Terms of Service or Community Guidelines

3.3 Content Moderation

While we provide moderation tools, we are not responsible for content created by users in Discord servers. Server administrators are responsible for managing their communities and ensuring compliance with Discord's policies and applicable laws.

4. Subscriptions and Payments

4.1 PRO Subscription

Our PRO plan is offered as a recurring subscription billed monthly or annually. By subscribing, you authorize us to charge your payment method at the beginning of each billing period.

4.2 Payment Processing

All payments are processed securely through Stripe. You must provide accurate payment information and promptly update it if it changes. We are not responsible for payment processing errors caused by incorrect information.

4.3 Billing and Renewal

• Subscriptions automatically renew unless cancelled before the renewal date
• Prices are subject to change with 30 days' advance notice
• Failed payments may result in suspension or termination of PRO features
• You are responsible for all charges incurred under your account

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard or by contacting support. Upon cancellation:

• PRO features remain active until the end of your current billing period
• You will not be charged for subsequent periods
• Your account will automatically revert to the free plan

Refund Policy: We offer a 14-day money-back guarantee for new PRO subscriptions. Refund requests must be submitted within 14 days of the initial purchase. Refunds are not available for renewal payments or after the 14-day period. Refunds are processed within 5-10 business days to the original payment method.

4.5 Free Plan

The free plan is provided at no cost but may have limited features and usage restrictions. We reserve the right to modify or discontinue the free plan at any time.

5. Intellectual Property Rights

5.1 Our Property

The Service, including all content, features, functionality, software, and design, is owned by Ashee (operated by Feelko.cz) and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

5.2 Your Content

You retain ownership of any content you create using the Service (such as custom commands, messages, or configurations). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide and improve the Service.

5.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service become our property, and we may use them without restriction or compensation to you.

6. Disclaimers and Limitations of Liability

6.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

6.2 No Liability for User Content

We are not responsible for content created, posted, or transmitted by users through Discord servers using our bot. Server administrators are solely responsible for moderating their communities.

6.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASHEE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

6.4 Third-Party Services

The Service integrates with third-party platforms (Discord, Stripe). We are not responsible for the availability, functionality, or policies of these third-party services.

7. Indemnification

You agree to indemnify, defend, and hold harmless Ashee, Feelko.cz, and their affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or transmit using the Service

8. Service Availability and Modifications

8.1 Availability

While we strive to maintain 24/7 availability, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or events beyond our control.

8.2 Changes to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We are not liable for any modifications, suspensions, or discontinuations.

8.3 Updates to Terms

We may update these Terms from time to time. Significant changes will be announced through the Service or via email. Your continued use after changes are posted constitutes acceptance of the updated Terms. If you disagree with changes, you must stop using the Service.

9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

9.2 Informal Resolution

Before filing any formal claim, you agree to contact us first and attempt to resolve the dispute informally for at least 30 days.

9.3 Jurisdiction

Any legal action arising from these Terms or the Service shall be brought exclusively in the courts of the Czech Republic, and you consent to the personal jurisdiction of such courts.

9.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

10. General Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ashee regarding the Service and supersede all prior agreements.

10.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

10.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

10.5 Survival

Sections that by their nature should survive termination (including provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification) will survive the termination of these Terms.
